EzyBid Auctions - Terms & Conditions

1. Bidder Registration
All bidders must be registered prior to participating in any Ezy Bid Auctions. Please allow up to 24 hours for registration processing before placing bids. Upon successful registration, a designated bidder number will be issued via email. This bidder number will serve as both your unique identifier and login password for future auctions.

 

2. Highest Bidder as Buyer
The highest bidder for each lot shall be deemed the buyer, except in cases where a reserve price applies or the lot is withdrawn.

 

3. Right to Refuse Bids
Ezy Bid Auctions reserves the right to refuse any bid or bidder without providing justification.

 

4. Withdrawal of Items
Sellers retain the right to withdraw any item from sale at any time.

 

5. Lot Descriptions
Lot descriptions including terms such as "A/F" ("As Found" - indicating faults or potential faults) or "Untested" (indicating an item may or may not be operational) will be explicitly stated.

 

6. Faults and Mis-descriptions
All lots are sold "as-is." Sales will not be invalidated due to defects, incorrect descriptions, missing parts, or quantity discrepancies. Neither EzyBid Auctions nor the seller shall be liable for compensation regarding such issues.

 

7. Risk and Payment Terms
Each lot becomes the buyer's responsibility from the moment the auction ends. Full payment must be made via bank transfer, EFTPOS, or cash before collection. Buyers must collect items at their own expense within three (3) days of the auction's end. Access to purchased lots may be restricted until payment is fully processed.

 

7.1 Ownership of goods does not transfer to the buyer until all payments have cleared in Ezy Bid Auctions’ bank account.

 

8. Goods and Services Tax (GST)
Buyers are responsible for paying GST on any applicable lots unless otherwise indicated.

 

9. Responsibility for Removal
Buyers assume full responsibility for any damage to property or injury to individuals resulting from the removal of purchased items, including damages or injuries caused by their agents or employees.

 

10. Conditions of Entry
All buyers and visitors enter auction locations or vendor premises at their own risk. Potential hazards, such as machinery or chemicals, may be present. Caution is advised. If in doubt contact us first.

 

11. Failure to Comply with Terms
Failure to comply with these terms may result in forfeiture of any payments made. The lot may then be resold, and any shortfall, along with associated expenses, will be the responsibility of the defaulting buyer.

 

12. Buyer’s Premium
A buyer’s premium applies to each item sold. The applicable rate will be stated at the beginning of each auction. In cases where the premium varies per lot, this will be clearly specified in the lot description.

 

13. Time Sensitivity of Sales
All auction sales are time-sensitive. Ezy Bid Auctions operates timed auctions exclusively.

 

14. Collection of Goods
Purchased goods must be paid for and collected within three (3) days of the auction’s conclusion unless prior arrangements have been made with Ezy Bid Auctions.

 

15. Payment Methods
Payments may be made via EFTPOS, bank transfer, cash, PayPal or internet banking. Card payments will incur a 2% surcharge. Bank transfers and PayPal must be cleared before the release of purchased items.

 

16. Occupational Health and Safety
Buyers must comply with the Work Health and Safety Act (WHS) 2012. Ezy Bid Auctions and vendors make no guarantees regarding the safety or fitness for use of any lot. Buyers are responsible for ensuring purchased items meet safety and compliance standards.

 

17. No Warranties or Representations
Ezy Bid Auctions and sellers make no warranties regarding the condition, quality, fitness for purpose, or compliance of any lot. To the fullest extent permitted by law, all implied warranties are expressly excluded.

17.1 Ezy Bid Auctions is not liable for any lot later identified as a non-original or reproduction, though we strive to prevent such occurrences viewing and your own research is strongly advised.

17.2 Buyers must conduct their own due diligence and assume all risks associated with their purchases. Buyers release and indemnify Ezy Bid Auctions, vendors, and related parties from any claims arising from purchased items.

18. Agreement to Terms
By registering with Ezy Bid Auctions, bidders acknowledge they have read, understood, and agreed to these Terms & Conditions. These terms are legally binding from the moment they are posted on the Ezy Bid Auctions website and may be updated without prior notice.
